Confronting the Reality of Due Process

I Did Not Assault Anyone

As I reflect on the events that transpired, it’s hard to see how I was perceived as a threat. I didn’t lay hands on anyone, I simply tried to protect a man named Edgardo from being taken away by ICE agents without due process.

The Unsettling Situation

When ICE officials arrived to strip Edgardo of his status and expedite his removal, I asked them to show me the judicial warrant. They claimed to have it, but refused to provide any further information or their badge numbers. The officers then ripped Edgardo away from me, and I was subsequently arrested.

A Pattern of Unjust Arrests

I am not the first person to be arrested for speaking out against the injustices of the immigration system. Senator Padilla, Mayor Ras Baraka, and recently, a journalist in Atlanta covering a protest, are just a few examples. I asked the authorities to explain their authority for arresting me, but none was provided.

A Concern for Due Process

As the situation unfolded, I was more concerned about Edgardo’s due process rights than my own. We don’t know where he is, and he is now in ICE detention. The judge gave him 30 days to appeal, but he doesn’t have a lawyer, leaving his future uncertain.

My Release and Ongoing Investigation

I was eventually released after 4 hours, and no charges have been brought against me. However, the case is still under review, leaving me to wonder what the consequences may be.

A Quest for Justice

What I wanted to do yesterday was ensure that people could safely return to their families and communities. I didn’t want anyone to go through what I went through, least of all Edgardo. What we all want is for people to have access to due process, present their asylum cases, and receive a credible fear hearing. We also want families to remain together, free from the fear of separation. This is what everyone deserves.
