Doctor pays for his error

KUWAIT CITY, Feb 16: The Administration Court ordered the Ministry of Health to pay financial compensation worth KD 20,000 to an expatriate woman for a medical error committed by a doctor while performing a Cesarean section which resulted in permanent disability of 15 percent of the body’s capacity and the possibility of not having children again.

Representing the plaintiff was Lawyer Zaid Al-Khabbaz, who sued the ministry for negligence and malpractice because his client developed health complications caused by malpractice of a doctor who conducted a Cesarean delivery but failed to follow the proper procedures entailed by medical protocol. This put his client’s life at risk, and created the possibility of not being able to have children in the future.

Lawyer Al-Khabbaz had called for an expert from the Forensic Medicine Department to re-examine his client and access her health status. He revealed that the forensic report indicated the percentage of permanent disability is estimated at 15 percent of the total body capacity and also highlighted the possibility of her inability to conceive in the future due to the medical error.
